Victims of Criminal Activity: Visa U and Visa WAVA

Victims must have suffered physical or mental abuse of a substantial nature due to criminal activity and possess information about that criminal activity. Police authorities must also certify that the victim has been, is being or is likely to be useful in the investigation or prosecution of criminal activity.

You can apply if you are, or were, the abused spouse of a US citizen. or of a permanent resident. You can also include in your petition your unmarried children under the age of 21 if they have not submitted an application themselves.

 

Parents: You can file an application if you are the parent of a child who has been abused by your US citizen spouse. or permanent resident. You can include in this petition children who have not been subject to abuse, if they have not presented themselves. You can also apply if you are the father of a US citizen, and you have been abused by your US citizen child.

 

Child: You can apply if you are under 21 years old, single and have been abused by your US citizen father. or permanent resident. Your children can also be included in your request. You can apply as a child after age 21, but before age 25 if you can show that the abuse was the main reason for not submitting the application on time.
